Terms of Service

1. Acceptance of These Terms

By downloading, accessing, or using Sleep History App ("Sleep History," "we," "our," or "us"), you agree to these Terms of Service. If you do not agree, do not use the app, website, or related services.

2. Subscription Terms

Sleep History offers auto-renewing subscriptions through Apple's App Store. Current standard prices shown in the app are:

• Monthly: US$14.99 per month
• Annual: US$69.99 per year

Pricing may vary by country, currency, tax, or App Store storefront. Payment will be charged to your Apple ID account at confirmation of purchase. Unless you cancel at least 24 hours before the end of the current billing period, your subscription will renew automatically. Your Apple ID account may be charged for renewal within 24 hours before the end of the then-current period.

You can manage or cancel your subscription at any time in your Apple ID account settings or through the App Store subscription management page. Subscriptions cannot be canceled from inside the Sleep History app, and cancellation turns off future renewal only. The current subscription period remains active until its end date unless Apple states otherwise.

3. Free Trial Terms

If a free trial is offered, the current promotional trial is 7 days unless the App Store product page or purchase screen states otherwise. If you do not cancel at least 24 hours before the end of the free trial period, your trial will automatically convert to the paid subscription plan you selected and Apple will charge your Apple ID account.

If you purchase a subscription before a free trial ends, any unused portion of the free trial may be forfeited to the extent permitted by Apple's rules.

4. Content Ownership and License

Sleep History, including its audio episodes, narration, music, artwork, text, design, logos, metadata, and other content, is owned by Sleep History or its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to stream and, where the app allows, download content solely for your personal, non-commercial use.

You do not acquire ownership of any Sleep History content by using the service. Except where we expressly allow it in writing, you may not reproduce, redistribute, sell, sublicense, publicly perform, publicly display, or otherwise exploit any part of the content.

5. Acceptable Use

You agree not to:

• share, redistribute, or resell Sleep History content or subscription access;
• reverse engineer, decompile, modify, or attempt to extract source code except where applicable law permits it;
• circumvent or interfere with subscription, entitlement, download, or playback protections;
• use the app or website in a way that disrupts our systems, harms other users, or violates applicable law.

6. Accounts, Suspension, and Termination

We may suspend or terminate your access to Sleep History if we reasonably believe you have violated these Terms, misused the service, engaged in fraud, attempted unauthorized access, or created risk or liability for us or others. If we terminate or suspend your account, your access to premium features may end immediately.

Deleting the app or stopping use of the service does not cancel an active App Store subscription. You must cancel through Apple to stop future renewal charges. We may retain certain account or usage records after termination as described in our Privacy Policy or as required by law.

7. Apple Terms and EULA

These Terms are between you and Sleep History, not Apple. Apple is not responsible for the app, its content, maintenance, or support except as required by law. Your use of Sleep History on Apple devices is also subject to Apple's App Store usage rules and Apple's standard end user license terms.

If Apple's Standard Licensed Application End User License Agreement applies to your download, it is incorporated by reference and is available at apple.com/legal/internet-services/itunes/mt/terms.html.

8. Disclaimers and Limitation of Liability

Sleep History is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted availability.

To the fullest extent permitted by law, Sleep History and its operators, affiliates, licensors, and service providers will not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, or for loss of profits, revenue, data, goodwill, or business opportunity arising out of or related to your use of the app, website, or content.

9. Governing Law and Jurisdiction

These Terms are governed by the laws applicable to the Dubai Silicon Oasis Free Zone, Dubai, United Arab Emirates, without regard to conflict-of-law principles. If you are a consumer, any mandatory rights available under the laws of your place of residence remain unaffected. Subject to those rights, disputes relating to these Terms or the service will be resolved in the courts of Dubai, UAE.

10. Changes to These Terms

We may update these Terms from time to time. When we do, we will post the revised version at sleephistory.app/terms, update the effective date above, and may provide additional notice in the app or on the website. Your continued use of Sleep History after updated Terms take effect means you accept the revised Terms.
